Royalties and Taxes: A Three Options Scenario Presented to Civil Society Organizations and Private Sector Entities

Building on a three-part series on Royalties and Taxes: A Three Options Scenario, the Australia Mongolia Extractives Program Phase 2 presented its findings on the 3rd and 5th of April, with the participation of some 30 participants from local civil society organizations and 60 representing industry, including professional and business associations.

Opening remarks at the event were made by State Secretary B. Byambadagva from the Ministry of Mining and Heavy Industry, introducing AMEP2’s research, with an emphasis on the importance of public participation in relation to the draft Mineral’s law.  Rena Guenduez, Team Lead for AMEP 2 stated in her opening remarks stated “that AMEP’s research aims to provide an opportunity to assess and identify distinct options, and in doing so build a pathway to building consensus on what is considered a “hot-topic” issue in the sector”.

As part of AMEP 2’s, “Royalties and Taxes: Consensus Building Through Consultation”, 2022-2023 activity and building on the programs previous activities related to royalties and taxes on minor elements, a series of interactive presentations and discussions were held.  Attendees were presented with three scenarios based on international best cases, including the current and proposed options reflected in the draft law. A legal review illustrated important considerations based on economic and fiscal frameworks and models. A presentation on royalties and tax options that estimate the composition and timing of revenue streams were also featured in the research, and focused on copper, coal, iron, and fluorspar. A cost-benefit analysis based on these commodities saw the conclusion of the presentations and resulted in a consensus building exercise and feedback process based on preferred options by participants.
